No 0000332738, VAT No 1132759449, share capital 40,014.00 PLN (hereinafter referred to as “Evertree Solutions”) is the owner and operator of this site (hereinafter referred to as the “Site”). Evertree Solutions places its materials at the Site on the following terms and principles (hereinafter referred to as the “Terms”). All rights to the Site and the Site Content not expressly granted are reserved. Using the Site does not constitute any license for copyright, trademarks, patents or other intellectual property rights, nor acquisition of any intangible property rights to the Site Content.

You may use the Site Content only within the permitted use defined by the provisions of law, in particular the Act on Copyright and Neighboring Rights and the Act on Database Protection. In particular, save the provisions of the above acts, copying, modifying and transferring electronically, or in any other manner, the Site Content or any part of it for commercial purposes without a prior written consent of Evertree Solutions is forbidden.

The Site purpose and the nature of activity

The only purpose of the Site is to provide its users with current information and enable them to contact Evertree Solutions. The Evertree Solutions products mentioned in the Site Content may under no circumstances be construed as the rendering services of financial statements audit in accordance with the Act on Statutory Auditors and their Self-Government of October 13, 1994 (Journal of Laws of 2001, No 31, item 359, as amended), keeping accounting records in accordance with the Accounting Act of September 24, 1994 (Journal of Laws of 2002, No 76, item 694, as amended), asset appraisal, property management and real estate brokerage in accordance with the Act on Real Estate Management of August 21, 1997 (Journal of Laws of 2004, No 261, item 2603, as amended), legal aid in accordance with the Act on the Bar of May 26, 1982 (Journal of Laws of 2009, No 146, item 1188), the Act on Legal Advisors of July 6, 1982 (Journal of Laws of 2002, No 123, item 1059, as amended) and the Act on Rendering Legal Aid by Foreign Lawyers in the Republic of Poland of July 5, 2002 (Journal of Laws of 2006, No 126, item 1069, as amended), taxation advice in accordance with the Taxation Advice Act of July 5, 1996 (Journal of Laws of 2008, No 73, item 443, as amended), intellectual property aid in accordance with the Act on Patent Agents of April 11, 2001 (Journal of Laws of 2001, No 49, item 509, as amended), insurance brokerage in accordance with the Act on Insurance Brokerage of May 22, 2003 (Journal of Laws of 2003, No 124, item 1154, as amended), nor may it be construed as banking activity in accordance with the Banking Act of August 29, 1997 (Journal of Laws of 2002, No 72, item 665, as amended), activity of co-operative savings and credit funds in accordance with the Act on Co-operative Savings and Credit Funds of December 14, 1995 (Journal of Laws of 1996, No 1, item 2, as amended), stock brokerage in accordance with the Financial Instruments Trading Act of July 29, 2005 (Journal of Laws of 2005, No 183, item 1538, as amended) or the activity of investment funds or investment fund companies in accordance with the Investment Funds Act of May 27, 2004 (Journal of Laws of 2004, No 146, item 1546, as amended). Wherever the Site Content mentions the above services or other activity which is subject to a separate consent or entry into a register or record, it shall mean that Evertree Solutions renders such activity in co-operation with its verified partners, which provide such services professionally or pursue such business activity, or that Evertree Solutions co-ordinates the work of such partners.

Disclaimers of warranty and limitations of liability

The Site Content is distributed without any warranty, expressed or implied, including, but not limited to, implied sales warranties, warranties of merchantability and warranties of fitness for a particular purpose. Evertree Solutions and its third-party Site Content providers make no warranties, expressed or implied, as to the ownership, validity, accuracy, completeness, accessibility and veracity of the Site Content.

On account of the Site’s purpose neither Evertree Solutions nor its third-party Site Content providers shall have any liability or responsibility for legal, financial or any other consequences of use of the information included in the Site Content. The character of this information is only general and demonstrative and all the risk associated with its use is borne solely by the user. Evertree Solutions and its third-party Site Content providers shall not be liable for any direct, indirect or incidental, damages or for moral harm or for lost revenue or profits of the user or third parties which are related in any way to the use of the Site Content, including, but not limited to, reaching a decision in a definite case, whether or not advised of the possibility of such damages or losses and regardless of the theory of liability. Despite due diligence, the endeavors to keep the Site Content sound and current may fail and inaccuracies may occur. Evertree Solutions and its third-party Site Content providers do not guarantee, explicitly or implicitly, the correctness, completeness and validity of the Site Content and shall not be liable for any of its possible errors, faults or invalidities. Evertree Solutions and its third-party Site Content providers shall also not be liable for the consequences of actions resulting from the use of such possible incorrect, incomplete or invalid Site Content.

Evertree Solutions shall also not be liable for any possible breaks in access to the Site and the Site Content and does not guarantee, explicitly or implicitly, the continuity of access to the Site and the Site Content. On being provided with access to the Site the user understands and accepts that no information sent by e-mail or transferred by the Internet in any manner whatsoever is confidential and that all such information may be exposed to third-party intervention. Third-party sites

Evertree Solutions does not represent any other Internet sites which are accessible by the Site, or which provide access to the Site (hereinafter referred to as “Other Sites”). Placing link at the Site to Other Sites or placing link to the Site at Other Sites is not an acknowledgement of any affiliation between the Site and Other Sites, save for these links, which are regulated by separate agreements. Evertree Solutions and its third-party Site Content providers shall have no liability for the content of Other Sites which are accessible by links placed at the Site. Final provisions

These Terms are governed by Polish law. The Site contains references to certain legal acts and provisions, which undergo amendments, and which therefore should be construed only in the circumstances in which they are quoted.

Evertree Solutions reserves the right to amend the Terms by updating this site without the necessity of prior notification being sent to the users. The amendments are binding upon their introduction. The users shall therefore periodically check the changes at the Suite in order to acquaint with the current Terms.
